Outcomes for Habilitation and DDS Adult Day Programs

Eligibility Determination

DOR Habilitation Services Program DDS Adult Day Program

A person is eligible for HSP/WAP and/or HSP/SEP services when all of the following exist:

  • The person is diagnosed as having a developmental disability;
  • The disability is so severe that the person does not presently have the potential for competitive employment;
  • The degree of the person's disability has been determined by DOR to be too severe to allow the person to benefit from VR services; and,
  • The person is determined to be in need of habilitation services in the IPP developed by a Regional Center case manager.

When DOR has made its determination of eligibility, the individual shall be placed in a WAP or SEP and shall be deemed presumptively eligible for the period not to exceed 90 days. During the period of presumptive eligibility, the WAP or SEP in which the individual is placed shall evaluate the performance of the individual in all of the following areas:

  • Appropriate behavior to safely conduct himself or herself in a work setting;
  • Adequate attention span to reach a productivity level in paid work;
  • Ability to understand simple instructions within a reasonable length of time;
  • Ability to communicate basic needs and understand basic receptive language;
  • Attendance level.

During the period of presumptive eligibility, the habilitation team shall, utilizing the findings of the WAP or SEP, determine the initial eligibility of the individual. [W&I Code, Section 19353.5]

HSP services shall continue as long as reasonable progress is being made toward achieving objectives of the Individual Habilitation Component (IHC) or as long as these services are determined by the habilitation team to be necessary to maintain the current level of functioning of the person. [W&I Code, Section 19353.5(b)]

Activity Center/Adult Development Center/Behavior Management
A person is eligible for Adult Day Program services if:

  • The consumer is at least 18 years of age, and
  • The consumer is not eligible for the same or similar services from a generic agency that is funded to provide the service to the general public with the exception of programs jointly funded by generic agencies and the Regional Center, and
  • The consumer's IPP includes an objective(s) which can be met by an adult day program. [W&I Code, Section 56744]

Activity Centers typically provide services for individuals who generally have acquired most basic self care skills, have some ability to interact with others, are able to make their needs known, and respond to instructions; [W&I Code, Section 54302]

Adult Development Centers typically serve individuals who are generally in the process of acquiring self help skills and who are in need of sustained support and direction in developing the ability to interact with others, to make their needs known, and to respond to instructions; [W&I Code, Section 54302]

Behavior Management Programs serve individuals with severe behavior disorders and/or dual diagnosis who, because of their behavior problems, are not eligible for or acceptable in any other community based program. [W&I Code, Section 54302](Individuals receiving behavior management services generally require professionally planned behavioral modification intervention to lessen the frequency and severity of behavior disorders.)
