(Emergency/Proposed Regulations)
Description
The Department of Developmental Services (Department) proposes to amend the regulations to allow In-Home Respite Agencies to request and anticipated rate adjustment to adjust their rate when the annual units of service fluctuates 25 percent or more from the units of service used in the cost statement upon their rate was based.

History
The Department filed its first Emergency Rulemaking package with the Office of Administrative Law (OAL) on August 31, 2001. OAL approved the proposed emergency regulations on August 31, 2001. Therefore, the first set of emergency regulations were effective on August 31, 2001. This first set of emergency regulations expired on August 9, 2002.
The Department filed its second Emergency Rulemaking package with OAL on August 6, 2002. OAL approved the proposed emergency regulations on August 9, 2002. Therefore, the second set of emergency regulations are effective on August 9, 2002.
The Department filed with OAL its Notice of Proposed Rulemaking on July 10, 2002. The Notice of Proposed Rulemaking will be published in the California Regulatory Notice Register on July 26, 2002. The 45-day comment period ended on September 13, 2002.
Status
OAL approved the Department’s regulations on July 28, 2003, and filed the regulations with the Secretary of State. The regulation is effective September 28, 2003.
