Assembly Bill 79 Rate Increase

General Information

Chapter 11, Statutes of 2020 (AB 79, Committee on Budget and Human Services Omnibus), provided the Department of Developmental Services with time-limited funding to provide rate increases for specified services effective January 1, 2021 through December 31, 2021. The rate increases are contingent upon approval of federal funding and shall be suspended at the end of this period unless certain conditions, specified in AB 79, apply.

Specified Services Receiving Rate Icreases

As required by AB 79, the following percentage increases will be applied to the following services:

  • Service Code 116: Early Start Specialized Therapeutic Services; 5% rate increase
  • Service Code 520: Independent Living Programs; 8.2% rate increase
  • Service Code 805: Infant Development Programs; 8.2% rate increase

Methodology

Effective January 1, 2021, the rate increase will be applied as a percentage increase to rates in effect on December 31, 2020.

Next Steps

DDS will submit a request for approval for matching federal funds to the Centers for Medicare and Medicaid Services (CMS). CMS has approximately 90 days to review the request. Contingent upon CMS approval, the rate increase will be implemented effective January 1, 2021.
