Rate Changes due to AB 1522, Employee Sick Leave

Due to the enactment of Assembly Bill (AB) 1522, employees who work on or after July 1, 2015, and work 30 or more days within a year are entitled to accrue sick leave at a rate of one hour for every 30 hours worked. Proposed trailer bill language will allow the Department of Developmental Services (Department) or the local regional center, depending on the type of vendor, to process rate adjustments for affected vendors.

Vendors affected by the requirements of AB 1522 with rates established in the following ways may be eligible for a rate adjustment:

Rates Set by the Department

Community-Based Day Program, Work Activity Program or In-Home Respite Agency providers may submit a rate adjustment to the Department by completing the workbook linked below. Cost and program information being requested shall only include costs necessary to fund a maximum of 24 hours or three paid sick days to applicable employees, and the units of service billed to the regional center for the period of January 1, 2015, through March 31, 2015. Vendors may begin submitting rate adjustment requests to the Department at any time, but they must be submitted no later than September 1, 2015. Any approved rate adjustment will be effective July 1, 2015.

Rates Set by Regional Centers Through Negotiation

Providers with a rate established through negotiation with a regional center should contact the regional center for more information on submitting a rate adjustment request.

Rates Set by the Alternative Residential Model (ARM) Rates

The proposed ARM rate schedule is effective July 1, 2015. Vendors with ARM rates will not need to submit a rate adjustment request.
