Rate Changes due to SB 616, Employee Sick Leave

Due to the enactment of Senate Bill (SB) 616, employers with employees who work on or after January 1, 2024, will increase the sick leave accrual rate for these providers to 40 hours or 5 days in each year of employment, previously required at 24 hours or 3 days. This bill will allow the Department of Developmental Services (Department) or the local regional center, depending on the type of vendor, to process rate adjustments for affected vendors.

Vendors affected by the requirements of SB 616 with rates established in the following ways may be eligible for a rate adjustment:

 

Rates Set by the Department

Community-Based Day Program, Work Activity Program or In-Home Respite Agency providers may submit a rate adjustment to the Department by completing the workbook linked below. Cost and program information being requested shall only include costs necessary to fund up to the additional requirement of 16 hours or two days to applicable employees, and the units of service billed to the regional center for the period of January 1, 2023, through December 31, 2023. Vendors may begin submitting rate adjustment requests to the Department at any time, but they must be submitted no later than July 1, 2024. Any approved rate adjustment will be effective January 1, 2024.

Providers with a rate established through negotiation with a regional center should contact the regional center for more information on submitting a rate adjustment request.

Alternative Residential Model (ARM) Rates

The updated Alternative Residential Model (ARM) rate schedule, effective January 1, 2024 can be found on the Rates by Regional Center page. Select the Regional Center and corresponding adult or children’s Community Care Facility rate schedule. Providers with ARM rates do not need to submit rate adjustment requests. The sick leave increase has been factored into the updated rate schedules.
